Secure Your Status in the UK before Brexit!

On Monday, 26 June 2017, HM Government published Proposals on "Safeguarding the Position of EU Citizens Living in the UK and UK Nationals Living in the EU". The 20-page document shows how the Government sees future immigration, benefits, pensions and other rights of European nationals living in the UK. There are a lot of ambiguities in the document and the future of EEA nationals is not clear.

The primary way to secure the status in the UK is an application for permanent residence for those who have been exercising treaty rights in the UK for the last 5 years.

There are number of advantages in getting your permanent residence status secured under current EEA Regulations.

1. Secured status
Your status in the UK will be secured, as permanent residence document confirms your current status, including your right to work in the UK.

2. Efficient process
The process of obtaining permanent residency has been in places for number of years, it is transparent and normally takes up to 6 months. After Brexit 3.3 million Europeans will apply for new residence documents during the period of not more than 2 years and the Home Office is likely to be extremely busy.

3. Become British
You can even get your British passport before Brexit. You can apply for naturalisation after 1 year of being permanent resident.

4. Save on Home Office fees
Current fee for permanent residence application is £65. The Secretary of the State proposes that a new fee will be set "at a reasonable level", however, fees are likely to rise.

5. Stress free travel
You can travel without worry during Brexit negotiations. A Permanent Residence card is a proof that you reside in the UK, so you are less likely to have any problems crossing the border. Remember not to stay outside the UK for more than 6 months.

6. Security for your family
Permanent residence will help to secure status for your family members. It is highly likely that under new rules family members will have to meet English language and "Life in the UK" requirements. The sponsor will also have to earn sufficient amount to bring new family members.

Soon the Government is going to introduce a replacement scheme under UK law to replace current residence documents with new ones. However, in the Policy papers they "seek to make sure that the application process for settled status is as streamlined as possible" for those who have already obtained confirmation of their permanent residence.
